1. Acceptance of Terms

These Terms and Conditions govern your access to and use of Grievyn, including our website, memorial creation tools, account features, communications, paid plans, exports, and related services. By creating an account, publishing or contributing to a memorial, making a payment, or otherwise using Grievyn, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the platform.

2. Service Scope

Grievyn provides a digital memorial platform that allows users to create, manage, publish, archive, export, and share online memorial pages. Features may include stories, photos, media galleries, audio tributes, condolences, candles, prayers, flowers, invitations, privacy controls, cultural themes, payment-enabled upgrades, and related support tools. We may improve, modify, suspend, or discontinue parts of the service when necessary to operate the platform, protect users, comply with law, or develop new features.

3. Eligibility and Authority

You must be able to enter into a binding agreement and may use Grievyn only in compliance with applicable law. If you create, manage, or contribute to a memorial, you represent that you have the appropriate authority, relationship, permission, or lawful basis to submit names, images, stories, service details, cultural information, and other content about the person being remembered and any living people mentioned or shown.

4. Accounts, Roles, and Access

You are responsible for providing accurate account information, keeping it current, and maintaining the confidentiality of your login credentials, sessions, manager permissions, and private access links. Owners and admins are responsible for activity that occurs through their accounts or memorial management access. You must promptly notify us if you believe your account, password, access link, or memorial permissions have been compromised.

5. Memorial Creation and Management

Memorial pages may include sensitive family, cultural, biographical, and remembrance information. You are responsible for the accuracy, legality, and appropriateness of content you publish or approve. Grievyn may provide tools for drafts, publishing, edits, invitations, exports, archiving, and deletion, but owners and admins remain responsible for managing memorial content and permissions.

6. Public and Private Memorial Settings

Grievyn may offer public, private, invitation, or access-link settings. Public memorials can be viewed, shared, copied, saved, indexed by search engines, or reposted by others. Private or link-access memorials reduce visibility but cannot guarantee that invited viewers will not forward links, take screenshots, copy content, or share what they see. Choose settings and content with that risk in mind.

7. User Content and License

You retain ownership of text, photos, audio, media, tributes, condolences, ceremony details, invitations, and other content you submit to Grievyn. You grant Grievyn a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, back up, moderate, translate, format, export, archive, and process that content solely as needed to operate, secure, support, and improve the service and provide requested memorial features.

8. Community Standards and Acceptable Use

You agree not to use Grievyn to post unlawful, abusive, harassing, hateful, exploitative, misleading, defamatory, obscene, graphic, spam, malware, or infringing content; impersonate another person; invade privacy or publicity rights; publish speculative or distressing death details without appropriate authority; scrape or harvest data; attempt unauthorized access; bypass security controls; or interfere with platform availability.

9. Moderation, Removal, and Preservation

We may review, remove, restrict, archive, restore, preserve, or disclose content, accounts, memorials, or access records when we reasonably believe it is necessary to enforce these Terms, protect users or the public, respond to legal process, address security or fraud risks, resolve ownership or family disputes, protect third-party rights, or operate the service responsibly.

10. Copyright and Intellectual Property Complaints

If you believe content on Grievyn infringes your copyright or other rights, contact us through the Contact page with the memorial link, identification of the protected work, the content you believe is infringing, your contact information, a statement that you have a good-faith belief the use is unauthorized, and a statement that the information you provide is accurate. We may remove or restrict content while we review a complaint and may request additional verification.

11. Plans, Billing, and Upgrades

Grievyn offers Free, Yearly, and Lifetime memorial plans. Some features require a paid upgrade, one-time purchase, recurring billing where offered, or third-party payment processing. Pricing, taxes, billing intervals, renewal terms, cancellation options, and available payment methods are presented at checkout or in your account when applicable. Every memorial can remain online at no cost with activity, but free memorials with extended inactivity may enter our stewardship process: reminders, data export options, archive, and eventual deletion only after 12 archived months. Yearly and Lifetime memorials are not subject to the free-plan inactivity archive workflow.

12. Exports, Deletion, and Backups

Owners and authorized admins may be offered export tools where available. Exports may not include every item if a file is unavailable, deleted, hosted by a third party, or technically inaccessible. If a memorial or account is deleted, removed, or downgraded, related content may become unavailable, although limited records, logs, backups, payment references, or legal/security records may be retained for legitimate operational, legal, billing, or safety reasons.

13. Grievyn Intellectual Property

The Grievyn platform, including our name, logo, branding, product design, software, interfaces, templates, documentation, and underlying technology, is owned by Grievyn or its licensors and is protected by intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, reverse engineer, resell, redistribute, or create derivative works from the platform.

14. Third-Party Services and Links

Grievyn may rely on or link to third-party services for payments, hosting, storage, email delivery, analytics, maps, media handling, support, or external websites. Those services may have their own terms, privacy practices, fees, availability, and security controls. Grievyn is not responsible for third-party services that we do not control.

15. Suspension and Termination

You may stop using Grievyn at any time. We may suspend or terminate access to accounts, memorials, exports, or features if we reasonably believe there has been a violation of these Terms, a security risk, fraudulent activity, non-payment, legal requirement, ownership dispute, or misuse that may harm users, the public, or the platform. Where appropriate, we may retain limited records as needed for legal, security, billing, dispute resolution, or enforcement purposes.

16. Disclaimer

Grievyn is provided on an "as is" and "as available" basis. We work to provide a reliable and respectful service, but we do not guarantee uninterrupted availability, error-free operation, indefinite storage, search engine behavior, third-party availability, or that the platform will meet every personal, cultural, legal, religious, or ceremonial need. Grievyn does not provide legal, medical, counseling, funeral-director, estate-planning, or emergency services.

17. Limitation of Liability

To the maximum extent permitted by law, Grievyn and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of data, loss of goodwill, emotional distress, service interruption, loss of profits, or unauthorized actions by other users, arising from or related to your use of the platform. Nothing in these Terms limits liability that cannot legally be limited.

18. Indemnity

You agree to defend, indemnify, and hold Grievyn harmless from claims, damages, liabilities, costs, and expenses arising from content you submit, your use of the service, your violation of these Terms, your violation of law, or your infringement or alleged infringement of another person’s rights, except where prohibited by applicable law.

19. Disputes and Governing Principles

If a dispute arises, contact us first so we can try to resolve it informally. These Terms are intended to be interpreted under applicable law without limiting consumer rights that cannot be waived. Any specific venue, arbitration, class waiver, or governing-law requirement may be added in the future if Grievyn adopts a formal business-law posture and provides appropriate notice.

20. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, operations, legal requirements, plans, or business practices. When changes are material, we will take reasonable steps to provide notice, such as updating the effective date or posting an in-product notice. Continued use of Grievyn after updated Terms become effective constitutes acceptance of the revised Terms.
